OVERVIEW

Welcome to DIVINED RACING. The terms “we,” “us,” and “our” refer to DIVINED RACING.

DIVINED RACING operates this store and website, including all related information, content, features, tools, products, and services offered to you (collectively, the “Services”). Our online store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with any policies referenced herein, describe your rights and responsibilities when accessing or using the Services.

Please read these Terms carefully. They contain important information regarding your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, purchasing from, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not access or use the Services.

By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence, or that you have reached the age of majority and have given any required consent for your minor dependents to use the Services on devices you own, purchase, or manage.

To use certain portions of the Services, including placing an order, you may be required to provide information such as your email address, billing information, payment information, and shipping address.

You represent and warrant that all information you provide is accurate, current, and complete and that you have the necessary rights to provide such information.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account. You may not transfer, sell, assign, or license your account to another person.

SECTION 2 — OUR PRODUCTS

We make reasonable efforts to accurately display and describe our products. However, product colors and appearance may vary depending on your device, display settings, lighting conditions, and other factors.

We do not guarantee that the appearance of a product on your screen will exactly match the physical product you receive.

Many DIVINED RACING products are made to order. Production begins after an order is placed rather than the product necessarily being pulled from pre-existing inventory. Production and delivery estimates are provided for convenience and are not guarantees.

Product descriptions, designs, prices, availability, specifications, and other product information may be changed at any time without notice.

We reserve the right to discontinue products or limit quantities offered to any person, geographic region, or jurisdiction where permitted by law.

SECTION 3 — ORDERS

When you place an order, you are making an offer to purchase products from DIVINED RACING.

We reserve the right to accept, decline, limit, or cancel an order where permitted by law, including in cases involving suspected fraud, payment issues, pricing or inventory errors, or other circumstances that prevent us from fulfilling the order.

Your order is not accepted until payment has been successfully processed and the order has been accepted by DIVINED RACING.

Please carefully review your order, including the selected product, size, color, customization, and shipping address, before submitting it.

Because many products are made to order and production may begin shortly after purchase, we may be unable to accommodate cancellations or changes once an order has entered production.

If we cancel or materially modify an order, we will attempt to contact you using the email address, billing information, or phone number provided with the order.

Returns, refunds, replacements, and related requests are governed by our Shipping & Returns Policy.

You represent and warrant that purchases are being made for lawful personal or household purposes and not for unauthorized commercial resale or export.

SECTION 4 — PRICES AND BILLING

Prices, promotions, discounts, and offers are subject to change without notice.

The price charged will generally be the price displayed at the time your order is placed, subject to correction of obvious pricing or technical errors as permitted by law.

Unless expressly stated otherwise, displayed product prices do not include applicable taxes, customs duties, import fees, or shipping charges.

Free U.S. Economy shipping is available on qualifying orders of $50 or more. Other applicable shipping charges are displayed during checkout.

You agree to provide current, complete, and accurate billing, payment, account, and contact information.

You represent and warrant that you are authorized to use any payment method submitted in connection with an order and that the information you provide is accurate.

SECTION 5 — SHIPPING AND DELIVERY

Most made-to-order apparel requires approximately 5–9 business days for production before shipment.

After production, estimated U.S. carrier transit time is approximately 3–7 business days. International delivery generally requires approximately 7–21 business days after shipment, depending on destination, customs processing, and carrier conditions.

For most U.S. made-to-order apparel orders, the typical total timeframe from purchase to delivery is approximately 2–3 weeks.

All production and delivery timeframes are estimates and are not guaranteed.

DIVINED RACING is not responsible for delays caused by carriers, customs authorities, severe weather, holidays, incorrect or incomplete addresses, or other events outside our reasonable control.

SECTION 6 — INTELLECTUAL PROPERTY

The Services, including our trademarks, logos, brand names, artwork, graphics, photographs, product designs, text, videos, audio, website design, and other content, are owned by or licensed to DIVINED RACING and are protected by applicable intellectual property laws.

These Terms permit you to access and use the Services for personal, non-commercial purposes.

Unless expressly authorized by DIVINED RACING or otherwise permitted by law, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, sell, or commercially exploit material from the Services.

Nothing in these Terms grants you ownership of or a license to DIVINED RACING's trademarks, copyrights, designs, or other intellectual property except as expressly stated.

DIVINED RACING's names, logos, product names, designs, graphics, slogans, and related brand elements may not be used without our prior written permission.

Shopify's trademarks and other third-party trademarks appearing through the Services remain the property of their respective owners.

SECTION 7 — OPTIONAL TOOLS

We may provide access to tools, features, applications, payment services, integrations, or other functionality provided by third parties.

We do not necessarily monitor or control these third-party tools.

Access to third-party tools may be provided “as is” and “as available,” subject to applicable law and the terms of the applicable third-party provider.

Your use of optional third-party tools is at your own discretion and may be subject to additional terms and privacy practices established by those providers.

We may introduce new features, tools, or resources in the future. Unless otherwise stated, those features will form part of the Services and will be subject to these Terms.

SECTION 8 — THIRD-PARTY LINKS

The Services may contain links to or integrations with websites, services, or content operated by third parties.

DIVINED RACING does not control and is not responsible for the content, accuracy, security, availability, products, services, policies, or practices of third-party websites.

If you choose to access a third-party website or service, you do so subject to that third party's applicable terms and policies.

Please review the policies and practices of third parties before entering into transactions with them.

Questions or disputes concerning products or services provided directly by a third party should generally be directed to that third party.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

DIVINED RACING is powered by Shopify, which enables us to provide the Services to you.

However, purchases made through our store are transactions directly between you and DIVINED RACING.

By using the Services, you acknowledge that Shopify is not the seller of DIVINED RACING products and is not responsible for the fulfillment of purchases made directly from DIVINED RACING.

To the extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, or liabilities arising directly from transactions between you and DIVINED RACING.

SECTION 10 — PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our store is powered by Shopify, Shopify may also collect and process personal information relating to your access to and use of the Services in order to provide and improve its platform and related services.

Information submitted through the Services may be transmitted to Shopify and other service providers involved in operating our store, processing payments, fulfilling orders, delivering communications, preventing fraud, providing analytics, or otherwise supporting the Services.

SECTION 11 — FEEDBACK AND USER CONTENT

If you submit, upload, post, email, tag us in, or otherwise provide ideas, suggestions, reviews, photographs, videos, feedback, proposals, or other content to us (“Feedback”), you represent that you have the necessary rights to provide that Feedback.

Where permitted by law, you grant DIVINED RACING a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, display, distribute, and promote Feedback you intentionally submit to us or make available to us for such purposes.

You represent that your Feedback will not violate the intellectual property, privacy, publicity, or other rights of another person and will not contain unlawful, defamatory, abusive, obscene, fraudulent, or malicious material.

You are responsible for the accuracy and legality of Feedback you provide.

We reserve the right, but are not obligated, to monitor, edit, or remove Feedback where appropriate.

SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS

Information available through the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, inventory, availability, or other matters.

We reserve the right to correct errors, inaccuracies, or omissions and to update information where appropriate without prior notice.

Where permitted by applicable law, we may cancel or modify an affected order if material information relating to that order was inaccurate.

You may use the Services only for lawful purposes.

You may not use the Services to:

  • Violate applicable laws or regulations;

  • Infringe our intellectual property rights or the rights of another person;

  • Harass, threaten, abuse, defame, intimidate, or harm another person;

  • Submit intentionally false, fraudulent, or misleading information;

  • Distribute spam, phishing attempts, malicious code, viruses, or other harmful material;

  • Scrape, crawl, interfere with, circumvent, or compromise security features of the Services without authorization;

  • Reproduce, duplicate, copy, sell, resell, or exploit the Services without authorization; or

  • Engage in conduct that interferes with another person's use of the Services or may expose DIVINED RACING, Shopify, our customers, or others to harm or liability.

We may suspend or terminate your access to all or part of the Services where permitted by law, including if you violate these Terms.

Termination does not eliminate obligations or liabilities incurred before termination.

Provisions that by their nature should survive termination—including provisions relating to intellectual property, disclaimers, limitations of liability, indemnification, governing law, and similar matters—will continue to apply.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT AS EXPRESSLY STATED BY DIVINED RACING, THE SERVICES AND PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

WE DISCLAIM WARRANTIES OR CONDITIONS THAT MAY LAWFULLY BE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT THE SERVICES WILL ALWAYS BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Nothing in these Terms is intended to exclude or limit consumer rights that cannot legally be excluded or limited.

SECTION 16 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DIVINED RACING AND ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.

THIS MAY INCLUDE, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR REPLACEMENT COSTS.

WHERE APPLICABLE LAW DOES NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS OF LIABILITY, THOSE EXCLUSIONS OR LIMITATIONS WILL APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

SECTION 17 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless DIVINED RACING and our affiliates, owners, officers, employees, agents, contractors, licensors, and service providers from third-party claims, liabilities, losses, damages, and reasonable legal expenses arising from:

  1. Your material breach of these Terms;

  2. Your violation of applicable law;

  3. Your violation of another person's rights; or

  4. Your unlawful or unauthorized use of the Services.

We will provide reasonable notice of an indemnifiable claim where appropriate, and you agree to reasonably cooperate in its defense.

SECTION 18 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, void, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law.

Any unenforceable portion will be treated as severed from these Terms without affecting the validity or enforceability of the remaining provisions.

SECTION 19 — WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce a right or provision under these Terms does not constitute a waiver of that right or provision.

These Terms, together with policies and operating rules posted through the Services, constitute the agreement between you and DIVINED RACING regarding your use of the Services and supersede prior agreements or communications concerning the same subject matter.

SECTION 20 — ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent except where applicable law provides otherwise.

We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, restructuring, sale of assets, or other lawful business transaction.

These Terms and any separate agreements through which we provide the Services will be governed by and construed in accordance with the laws applicable in the jurisdiction in which DIVINED RACING is headquartered, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

Any disputes will be subject to the jurisdiction of courts having lawful authority over DIVINED RACING and the applicable dispute, except where applicable law provides you with the right to bring proceedings elsewhere.

Section headings are provided for convenience and organization only and do not limit or otherwise affect the interpretation of these Terms.

The current version of these Terms may be reviewed on this page at any time.

We reserve the right to update, modify, or replace portions of these Terms by posting an updated version through the Services.

Where required by applicable law, we will provide appropriate notice of material changes.

Your continued use of the Services after revised Terms become effective constitutes acceptance of those revised Terms to the extent permitted by law.
